Terms & Conditions

The ozjam.com.au Service is a way for musicians to search and connect with each other online. In these terms and conditions (Terms), "us", "we", "our", “Site”, “Service” or “Ozjam”, means ozjam.com.au (ABN 35 729 851 028). ozjam.com.au is provided by Ozjam Australia.

This is a legally binding Agreement between you and Ozjam so it is important to us that you understand these Terms. Please read the Terms carefully before registering for our Service. If you have any questions, please contact us at or via our ‘Contact Us’ page.

IF YOU DO NOT AGREE TO THE TERMS, please do not register for, or use, the Ozjam Service.

  • Agreement
    • This Terms and Conditions of Use Agreement sets forth the legally binding Terms for your use of the Ozjam Service. By accessing and using the Service you certify that you have read and agree to be bound by the Terms of this Agreement, and any other terms and conditions, notices and disclaimers displayed elsewhere on the Site relating to your use of the Service, whether you are a "visitor" (which means that you either simply browse the Site or login to the Forum), or you are a "member" (which means that you have registered with Ozjam as either a Standard or VIP Member). The term "User" refers to both a visitor or a member.
    • As a User you also grant us consent to use the personal information you provide, or that we obtain, in accordance with our ‘Privacy Policy’, and you acknowledge that our Privacy Policy forms part of these Terms.
    • c) We may change the Ozjam Terms at any time. If we do, an amended version of the Terms will be posted on the Site. You are responsible for ensuring that you regularly review the Terms. Your continued use of Ozjam after any changes are made will be deemed to constitute your acceptance of those changes. If you object to any changes to the Terms, or otherwise become dissatisfied with your membership to the Ozjam Service, your only resolve is to immediately:
      • discontinue your use of Ozjam, or
      • terminate your membership in accordance with the Ozjam Terms (see Term 3)
  • Standard and VIP Membership
    • When registering as an Ozjam member, you must provide us with accurate, up-to-date and complete information as requested. It is your responsibility to inform us of any changes to that information, and to maintain and update your information to keep it accurate, current and complete. You may do this at any time by accessing your ‘Maintain Account’ settings.
    • You must be at least 13 years old to use the Ozjam Service. Therefore by using our Forum and/or becoming a member, you represent and warrant that you are at least 13 years old. You must not attempt to use this Site if you are under 13 years of age.
    • You must also warrant that you may legally use this Service. If you are under contract with an agent or management company who states that the use of this type of service is prohibited, you may not register with Ozjam.
    • You may not authorize others to use your musicians membership. In the case of band memberships, only the band members listed on your Ozjam profile may use the Site with your permission, however by doing so you accept that you are legally responsible and liable for their conduct in accordance with the Ozjam Terms.
    • You are not permitted to assign or otherwise transfer any membership, services or features registered and/or purchased by you to any other person or entity.
    • There are two types of membership to the Ozjam Service; Standard Membership and VIP Membership.

    • Standard Membership

      • If you register and use Ozjam as a Standard Member you are entitled to full use of the Service with the following exclusions;
      • You will not be eligible for the Monthly Prize Giveaway
      • You will not have access to the Band Name Creator service
      • You will not be permitted to post items on the For Sale Notice Board
      • You are limited to one (1) video attachment per profile
      • You are limited to two (2) audio attachments per profile
      • You may change your Standard Membership to a VIP Membership at any time by choosing the ‘Upgrade Membership’ option in your ‘Maintain Account’ area, and paying the required membership fee.

    • VIP Membership

      • If you register and use Ozjam as a VIP Member (a member who has pre-paid the monthly fee in full) you are entitled to full use of the Ozjam Service with no exclusions, as follows;
      • You will be eligible for the Monthly Prize Giveaway
      • You will have access to the Band Name Creator service once every 30 days
      • You are entitled to unlimited postings on the For Sale Notice Board
      • You are entitled to three (3) video attachments per profile
      • You are entitled to five (5) audio attachments per profile
      • Each VIP Membership entitles you to set up one musician, or one band profile. You may set up as many VIP Memberships as you require. To renew your VIP Membership simply choose the ‘Renew Membership’ option in your ‘Maintain Account’ area, and pay the required membership fee.
  • Deleting Profiles, Termination and Suspension

    • Member Terminating Account

      • If you wish to delete your profile as a Standard Member simply choose the ‘Delete My Profile’ option in your ‘Maintain Account’ area. Deleting your profile does not delete your membership. You may login again at anytime and reactivate your profile by reentering your details in the ‘Edit My Profile’ option in your ‘Maintain Account’ area. Once you have deleted your profile your profile’s details including friends, images, music and video clips will be removed. However your name, gender, date of birth and location for musicians, and name and location for bands will remain and still be viewable to other Users.
      • If you wish to terminate your Ozjam Standard Membership at any time and for any reason, and thereby completely remove your profile and sign up information from the Site, then you can provide notice of termination, with or without explanation, by emailing us at or via our ‘Contact Us’ page. Your profile will be visibly removed from the Service within five working days of receiving your notification and you will therefore need to re-register as a member if you wish to use the Site again.
      • Your VIP Membership will automatically revert/change to a Standard Membership (including exclusions; see Term 2) at the end of your pre-paid 30 day period unless you renew your VIP Membership using the ‘Renew Membership’ option in your ‘Maintain Account’ area, or terminate your membership.
      • If you wish to delete your profile while you are a VIP Member simply choose the ‘Delete My Profile’ option in your ‘Maintain Account’ area. Deleting your profile does not delete your membership. However, removing your profile does not suspend or extend your pre-set 30 day VIP Membership period, and in no event will you be entitled to any refund, in part or full, of your pre-paid membership fees. If you reactivate your profile (by reentering your details in the ‘Edit My Profile’ option in your ‘Maintain Account’ area) during the pre-set 30 day period you may use the remaining days as a VIP Member. If you do not reactivate your profile before the pre-set 30 day period is up your VIP Membership will automatically revert/change to a Standard Membership (including exclusions; see Term 2). Once you have deleted your profile your profile’s details including friends, images, music and video clips will be removed. However your name, gender, date of birth and location for musicians, and name and location for bands will remain and still be viewable to other Users.
      • If you wish to terminate your Ozjam VIP Membership before your 30 days expire for any reason, and thereby completely remove your profile and sign up information from the Site, then you can provide notice of termination, with or without explanation, by emailing us at or via our ‘Contact Us’ page. However, In no event will you be entitled to any refund, in part or full, of your pre-paid membership fees.
      • Your profile will be visibly removed from the Service within five working days of receiving your notification and you will therefore need to re-register as a member if you wish to use the Site again.
      • You are not entitled to a suspension or extension of your VIP Membership at any time or for any reason.

    • Ozjam Terminating Member

      • Ozjam reserves the right to terminate your access to and use of the Service at any time;
        • for any reason and without explanation by providing notice to you by email, or
        • without notice to you if you have committed a breach of the Ozjam Terms
        • if we conclude that your conduct impacts our name or reputation
        • if we conclude that your conduct violates our rights or those of another Ozjam User
        • if we have reason to believe that you are under 13 years of age
        • or if your registration data is found to be inaccurate, not current or incomplete in any respect
        • If we do terminate your VIP Membership because you have breached the Terms, you shall not be entitled to the refund of any unused portion of your pre-paid membership fees.
      • We also reserve the right to, without limitation, notice or explanation, do any or all of the following in relation to your membership;
        • suspend your membership
        • permanently or temporarily hide all or part of your member profile
        • permanently or temporarily block your access to all or part of Ozjam
        • modify your member profile
  • Fees, Services and Features
    • VIP Members are required to pay the 30 day membership fee to be entitled to use the additional features of the Ozjam Service (see Term 2).
    • We do not accept cash payment for our VIP Membership fees. Please refer to the available credit card payment method located within the Site. VIP Membership fees are GST inclusive.
    • In the event of any unusual activity in relation to your payment of membership fees, we reserve the right to temporarily or permanently suspend payment via your credit card and contact you, your bank or any other relevant third party to report such activity.
    • We reserve the right to change any fees for using the Service at any time, effective by posting the changes on the Ozjam Site. If you are unhappy with a change of fees you are entitled to discontinue your use of Ozjam and/or terminate your membership in accordance with the Ozjam Terms (See Term 3).
    • Ozjam Australia provides the Ozjam Service on an ‘as is’ basis and gives no warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement, expressed or implied, in any communication with Ozjam or its representatives, or otherwise with respect to the Service.
    • While we use reasonable endeavours to ensure that the Ozjam Service is available 24 hours a day, we disclaim liability for and make no representations or warranties that your access will be secure, always available, uninterrupted, error free, will meet your requirements, or that any defects in the Service will be corrected. Access to Ozjam may be suspended temporarily without notice in the case of system failure, maintenance or repair or any reason beyond our control.
    • We reserve the right to change or discontinue any service or feature of Ozjam in whole or in part at any time.

    • For Sale Notice Board

      • The Ozjam For Sale Notice Board is a place for VIP Members to advertise their music-related items for sale. Standard Members are permitted to buy items through the For Sale Notice Board, however they must be a VIP Member to post an item for sale.
      • Please keep in mind that the items for sale are posted by Ozjam VIP Members and not by Ozjam. Therefore Ozjam is not involved with or a party to any actual transactions that take place between members (buyers and sellers) and to the extent permitted by law Ozjam specifically disclaims all liability for any loss or damage of every kind and nature (actual, special, direct, indirect, consequential, known and unknown, suspected and unsuspected, disclosed and undisclosed) arising out of or in any way connected with your transaction.
      • Buyers and sellers are solely responsible for all aspects of the transactions in which they participate, and therefore they must resolve any conflicts that arise from transactions on the Ozjam For Sale Notice Board. This includes but is not limited to the sale and exchange of the goods listed on the For Sale Notice Board.
      • All transactions on Ozjam For Sale Notice Board must comply with any applicable laws and the rest of the Ozjam Terms.
      • You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service other than where allowed on the For Sale Notice Board or by listing yourself as a tutor for tutoring services in the Forum.
      • Ozjam reserves the right to reject or remove any For Sale listing at any time for any reason without notice.

    • Online Forum

      • You are fully responsible for any information or file supplied by you on the Forum (see Terms 6, 7 and 9), so if you do not agree with the rules and policies stated in the Ozjam Terms, you may not participate in the Forum.
      • In addition, please note that the practice of bumping threads is not permitted in the Forum.
      • Remember that all information that is disclosed in the Forum becomes public information and you should exercise caution when deciding to share any of your personal information (see Term 8).
      • You understand and agree that we reserve the right to review, remove or modify any data submitted by you to the Forum for any reason that we feel constitutes a violation of our Terms including our Privacy Policy whether stated, implied or otherwise.
      • If you breach any of the Ozjam Terms you will be banned from the Forum and/or your Ozjam membership will be terminated.
      • Any member who finds material posted by another User objectionable is encouraged to contact us at or via our ‘Contact Us' page.

    • Band Name Creator

      • Use of the Ozjam Band Name Creator is for Ozjam VIP Members only. Each VIP Member is entitled to apply for one band name only within their 30 day membership period.
      • Once you have submitted your ‘Unique Band Name Questionnaire’ from the ‘How to Create A Great Band Name’ article, you will receive your band name suggestion within 14 days. Ozjam does not guarantee that you will like or use your suggested band name and are not obligated to re-issue you with another band name for any reason.
      • Although every endeavour has been made to produce a unique band name for your band, Ozjam does not accept any liability for the originality of the name and does not offer any guarantee that the name is not already in use. Ozjam therefore recommend that before you use your band name that the relevant checks are made to ensure that the band name is not currently in use.
      • Ozjam reserve the right to withhold releasing the suggested band name if for any reason whatso-ever the Unique Band Name Questionnaire is deemed by us to be filled out incorrectly or is incomplete. Monthly Prize Giveaway

    • Monthly Prize Giveaway

      • You must be a current pre-paid VIP Member to be eligible for the Monthly Prize Giveaway, with no exceptions. However, because your VIP Membership lasts for 30 days, VIP Members joining on the first day of a 31 day calendar month may not be a VIP Member on the day of that months draw. They will however still be included in the draw at the end of the calendar month in which they were a VIP Member. Standard Members are not eligible for the Monthly Prize Giveaway.
      • One VIP Member will be randomly selected from all current pre-paid VIP Members on the last day of each calendar month to receive the monthly prize.
      • The winner will be chosen completely at the discretion of Ozjam Australia and their decision will be final and no discussion or correspondence will be entered into.
      • The winning member’s photograph and details as well as a link to their profile will be posted on the Ozjam home page on the first day of every calendar month following the draw. It is a condition of acceptance of the prize that Ozjam has the right to display the member’s photograph and details on the Sites home page.
      • An email will be sent to the winning member’s external email address notifying them of their prize along with its collection details.
      • It is the winning members sole responsibility to collect the prize from the designated collection point in their state. Although Ozjam will endeavour to make the collection point as close as possible to the winning member, Ozjam is not responsible for any additional costs incurred in collecting the prize including but not limited to, travel costs or loss of income from taking time off work, study or any other activities.
      • The member must provide photographic identification (i.e. driver’s license, passport) at the collection point to claim their prize and the prize must be signed for by the member before it is released.
      • If the winning member is under 18 years of age the prize must be signed for by the member’s parent or legal guardian before it is released. If the prize is to an event that does not permit the entry of persons under 18 years of age that member must nominate a parent or legal guardian to receive the prize.
      • It shall be deemed that by claiming the prize that the winning member (and/or parent or legal guardian) has agreed to the Terms of the monthly prize draw without exclusion.
      • The winning member will have three (3) months to claim their prize. Prizes unclaimed after a period of three (3) months will be forfeited subject to state regulations.
      • All members must acknowledge that Ozjam Australia, even after they have awarded or appeared to have awarded the prize to a member, or after a member is announced as the monthly prize winner, may stop the member from receiving the prize if it is found that they are in violation of any of the Ozjam Terms. Ozjam also reserves its right to require the return of the prize or payment of its recommended retail value to Ozjam Australia if this occurs.
      • All prizes must be accepted as awarded.
      • Prizes awarded may not be exactly as illustrated.
      • All prizes are subject to availability, non transferable and non exchangeable, and are not redeemable for cash unless specified.
      • Once the prize is received by the member normal warranty conditions as stipulated by the supplier apply.
      • Ozjam Australia will not be responsible or liable if for any reason beyond their reasonable control any element of any prize is not provided.
      • Prizes may vary from month to month and therefore the value of the prize may vary from month to month.
      • Prize values may or may not be displayed on the Ozjam Site. However if they do appear they are the recommended retail value as provided by the supplier, are in Australian dollars, and are correct at the time of posting on the Site.
      • Ozjam may subject to state regulations substitute a different prize of equivalent recommended retail value in place of any monthly prize.
      • Ozjam will not be responsible for any changes in times, dates, cancellations or rescheduling of events that may prevent a prize winner from redeeming a prize or any part of it.
      • Obtaining time off work, study or other activities to participate in a prize will be the sole responsibility of the member.
      • Ozjam does not warrant the merchantability, suitability and/or fitness for the purpose of any goods and/or services given as prizes.
      • Employees and the immediate families of Ozjam Australia are ineligible to be prize winners if they are VIP Members. Employees and the immediate families of all associated sponsors, advertisers and participating companies are also ineligible to win.
      • Ozjam accepts no responsibility or liability that if for any reason the Monthly Prize Giveaway is not capable of running as planned including but not limited to technical failures, unauthorized intervention, computer virus, or any other causes beyond our control.
      • Ozjam may change the Terms of, or terminate the Monthly Prize Giveaway at any time without liability to any VIP Member or any other person. A prize will therefore not be given on the last day of the month if the prize giveaway has been terminated.
  • Access Security
    • You are responsible for maintaining the confidentiality and security of your login details (email address and password).
    • You are wholly responsible for all activities that occur under your email address and password, and authorize us to assume that any person using the Ozjam Site with your email address and/or password is either you or another band member authorized by you to act for you.
    • You agree to immediately notify us of any unauthorized use of your Ozjam email address or password.
    • You are responsible for logging out of your Ozjam account at the end of each session. This will assist in preventing unauthorized access.
    • Ozjam may at any time request a form of identification to verify your identity and/or your compliance with the Ozjam Terms.
    • Whilst every precaution is taken to ensure that our members are transacting with us in a safe and secure environment Ozjam Australia does not accept any responsibility for any losses or damages incurred by a member whose credit card has been used fraudulently or in an unauthorized manner.
  • Content
    • As a User you agree not to post or transmit on Ozjam, or otherwise transmit to any other User of Ozjam by any other means Content (including images, photos, video, audio, text, files or any other materials) that:
      • is incomplete, false, inaccurate or misleading in any way
      • contains the personal information of any person
      • is of any person other than you and/or those listed in the profile as current consenting members of your band without their consent
      • infringes the rights and/or invades the privacy of any third party
      • you do not have a right to make available under any law or contractual obligation
      • is unlawful, obscene, indecent, lewd, “flaming”, defamatory, vulgar, profane, offensive or inappropriate in any way
      • is excessively violent
      • contains, nudity, sexually explicit references/innuendo, or a link to an adult website
      • contains restricted or password only access pages, or hidden content
      • contains viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment
    • You are solely responsible for Content that you post or transmit on Ozjam or otherwise transmit to any User of Ozjam by any other means in both the public areas of the Service and in your private email messages. Emails sent between you and other members that are not readily accessible to the general public will be treated as private by Ozjam to the extent required by law.
    • We are not responsible for and accept no liability with respect to any Content posted or transmitted on Ozjam or otherwise transmitted to any User of Ozjam by any other means by any person
      • .
    • We reserve the right but have no obligation to monitor and/or review Content posted or transmitted in the public areas of Ozjam or (where possible) otherwise transmitted to any User of Ozjam by any other means.
    • Without limiting your responsibilities under the Ozjam Terms we reserve the right to modify and/or remove any Content that in our opinion violates or is alleged to violate the law or the Ozjam Terms or otherwise has the potential to harm, endanger or violate the rights of any person.
    • We do not make any representations or warranties as to the accuracy, reliability, completeness or usefulness of any Content posted or transmitted on Ozjam or otherwise transmitted to any other User of Ozjam by any other means by any person.
    • Furthermore, we do not endorse any opinion, advice, offers or statements made available through the Ozjam Service by any person other than us and so they should not be necessarily relied upon. Such persons are solely responsible for such Content. Therefore you will not express or imply that any statements you make are endorsed by us without our specific prior written consent.
    • We do not accept any liability for any loss, damage, cost or expense resulting from anyone’s reliance on Content posted or transmitted on Ozjam or otherwise transmitted to any other User of Ozjam by any other means.
  • Use of Ozjam and Prohibited Activities
    • Ozjam is for the personal use of individual musicians and band members only. Businesses, groups, organisations and companies are prohibited from registering as members or using our Forum.
    • Ozjam must not be used to post or transmit any commercial activity of any kind by you or on behalf of a third person, including but limited to advertising (including posting blogs or bulletins with a commercial purpose), selling or hiring products or services, collecting names and/or email addresses or sending unsolicited emails.
    • As a member you will have a profile (or profiles) on the Ozjam Service that is/are viewable to any User of the Ozjam Site, however only registered members will be able to contact you through the Service.
    • You must not include in your profile any telephone/mobile numbers, street addresses or email addresses other than where asked for on the ‘Sign Up Information’ page.
    • You are also prohibited from including the programming code or personal information for any alternative internet communication methods in your profile.
    • You must not display an advertisement or any other commercial content on your profile, or select a profile with a commercial purpose as one of your “friends” on your friends list, or send private messages with a commercial purpose.
    • Ozjam reserves the right, but has no obligation to reject any profile that does not comply with the above prohibitions.
    • In addition, you agree not to use the Ozjam Service to;
      • defame, abuse, harass, stalk, threaten or otherwise offend others
      • promote racism, bigotry, hatred, harassment or any kind of harm against any group or individual
      • impersonate another User, member, band or any other person or entity
      • promote or provide information about illegal activities or conduct
      • exploit or solicit information from any person under the age of 18
      • solicit money, passwords or personal information from any person
      • engage in, promote or transmit to other members or non-members any surveys, contests, pyramid schemes, junk mail, chain letters, instant messaging, spimming or spamming (unsolicited bulk e-mailing), or any other form of communication. If you breach our Terms by transmitting unsolicited bulk email, instant messages or other unsolicited communications of any kind through the Ozjam Service you acknowledge that you will have caused significant harm to Ozjam. As a reasonable estimation of such harm you agree to pay Ozjam $25 (AUS) for each such unsolicited email or other communication you send through the Service
      • promote an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files
      • use any robot, spider or other device or process to search/retrieve, index, data mine or in any way reproduce or circumvent the navigational structure or presentation of Ozjam or its contents
      • use meta tags or code or other devices containing any reference to Ozjam to direct other persons to any other web page for any purpose
      • use "framing", "mirroring" or “linking” of any part of the Ozjam site without our prior written authorization
      • cover or obscure the banner advertisements on your personal profile page or any other Ozjam page by any means
      • forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service
      • except and only to the extent permitted by law, modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of Ozjam or any software used on or for the Site or cause any other person to do so
      • interfere with or disrupt the Service or the Site or the servers or networks connected to the Service or the Site
    • You agree to use the Ozjam Service in a manner consistent with any and all applicable laws and regulations.
    • We have no obligation to monitor any User’s use of Ozjam, however we reserve the right at all times to monitor, retain and disclose any information as necessary to satisfy any applicable law, legal requirement, police investigation or governmental request.
    • We also reserves the right to investigate and take appropriate legal action against anyone who in our sole opinion violates any of these Terms, including without limitation reporting you to law enforcement authorities.
    • If you become aware of any misuse of the Ozjam Service by any person, please contact us at or via our ‘Contact Us' page.
  • Safe Interaction, Complaints and Disputes
    • A WARNING - PLEASE READ THIS: Unfortunately it is possible that other Ozjam Users (including unauthorized users or "hackers") may use Ozjam in violation of the Ozjam Terms. For example, it is possible that another member may post or transmit offensive or obscene content on the Ozjam Service that you may be involuntarily exposed to, or they may use Ozjam to harass or injure you.
    • Neither Ozjam, nor the Users participating are responsible for the privacy practices of any User. Therefore we urge you to be cautious when interacting with other Users of Ozjam.
    • You should carefully select the content that you post or transmit on Ozjam or otherwise transmit to any other User by any other means as it will be considered non-confidential. Remember, you must not include any telephone/mobile numbers, street addresses, URLs or email addresses in your member profile or on the Forum.
    • If you are experiencing problems with any other User of the Ozjam Service and would like to make a complaint, please contact us at or via our ‘Contact Us’ page.
    • You are solely responsible for your interactions with other Ozjam Users. However, we reserve the right but have no obligation to monitor disputes between Users of Ozjam.
    • We may therefore record and store any information relating to any complaint made against you.
    • You agree to hold us harmless in connection with any dispute or claim that you make against any other User of Ozjam (See Term 11).
  • Proprietary Rights
    • Ozjam does not claim any ownership rights in the Content (including images, photos, video, audio, sounds, musical works, works of authorship, text, files or any other materials that you post on the Service). After posting your Content to the Ozjam Service you continue to retain all such ownership rights. However, by posting your content on or through the Ozjam Service, and Subject to our obligations under our Privacy Policy you hereby grant us a limited license to use, modify, publicly perform or display, reproduce, and distribute such Content solely on and through the Ozjam Service. This is because without this license we would be unable to perform the technical requirements needed to provide the Ozjam Service, nor allow Users to view, or listen to music posted by its members. The limited license you grant to us is non-exclusive, fully-paid and royalty-free (meaning that we are not required to pay you for the use of your posted Content), sub licensable (to allow Internet content delivery networks to provide the Ozjam Service), and worldwide (because Internet access is global). This license will terminate at the time you remove your Content from the Service. The license does not grant Ozjam the right to sell your Content, nor does the license grant us the right to distribute your Content outside of the Service.
    • You represent and warrant that;
      • you own the Content that you post or transmit on Ozjam or otherwise transmit to any other User by any other means or otherwise have the right to grant us the limited license stated above.
      • any Content that you post or transmit on Ozjam or otherwise transmit to any other User by any other means will not infringe or otherwise violate the privacy rights, publicity rights, copyrights, contract rights, trademark, trade secret or other intellectual property, or any other rights of any person.
      • You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content that you post or transmit on Ozjam or otherwise transmit to any other User by any other means.
    • The Ozjam Service contains the Content of Users and other third parties. Except for Content posted by you, you will not post, store, copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell in any form or by any means, in whole or in part, any Content that has been posted or transmitted on Ozjam or otherwise transmitted to any other User of the Service without the prior express written permission of the relevant owner.
    • You also agree not to post, modify, distribute, or reproduce in any way any Content containing copyrighted material (that has copyright protection whether or not it is identified as copyrighted), trademarks, or other proprietary information that is not owned by yourself without obtaining the prior written consent of the owner of such proprietary rights.
    • Any User found in violation of the copyright rights of others will be immediately terminated from the Site upon notification by the copyright owner or the copyright owner’s legal agent.

    • You must not remove any copyright, trademark or other proprietary rights notices contained in the Site.
    • Ozjam hereby grants you a limited, revocable, non sublicensable license to reproduce and display the Ozjam Content (excluding any software code) solely for your personal use in connection with viewing the Ozjam Site and using our Service.
  • Third Party Websites, Advertising and Activities
    • The Ozjam Service contains links, hyperlinks and pointers to websites and/or files operated by third parties. If you link to any third party websites or files you leave Ozjam entirely at your own risk.

    • Ozjam may also from time to time promote, advertise, or sponsor functions, events, offers, products, services, competitions or other activities that may be conducted on or offline by third parties (Third Party Activities). Third Party Activities may be subject to separate terms and conditions. You acknowledge that you participate in any such Activities entirely at your own risk.
    • In relation to Third Party Activities conducted by any third party (even if such third party has been contracted by us or Ozjam is associated with such activity) we do not accept any liability for any loss, damage, cost or expense that you suffer or incur as a result of or in connection with your participation in such Activities.
    • In relation to Third Party Activities conducted by us to the maximum extent permitted by law we exclude all implied representations and warranties which, but for the Ozjam Terms, might apply in relation to your participation in relation to such Activities. To the extent that our liability cannot be excluded by law our maximum liability to you will be limited to the amount paid by you (if any) for your participation in the event.
  • Limitation of Liability and Indemnity
    • Ozjam does not screen Users of the Ozjam Service in any way. As a result you acknowledge that you use Ozjam at your own risk.
    • We also cannot guarantee that each User is at least the required minimum age, nor do we accept responsibility or liability for any content, communication or other use or access of the Site by persons under the age of 13 in violation of these Terms.
    • You acknowledge that we are not responsible for, and in no circumstances will we be liable to you or any third party (including unauthorized users or ‘hackers’) for any incidental, indirect, consequential, exemplary, special or punitive damages, loss or expense including but not limited to; loss of income, profits, goodwill, data, programs, contracts, use of money, emotional distress and discomfort, physical damages, personal injury and/or death; or loss or damages arising from or in any way connected to the cost of procurement of substitute services, or service (business) interruption of any type, whether in tort, contract or otherwise, arising out of the use of (including communicating and/or meeting with other Users of this Service, or introduced to you via this Service), or inability to use, or conduct in connection with the Ozjam Service. Even if Ozjam Australia or its agents or representatives know or have been advised of the possibility of such damages, or to any person other than you.
    • You agree to defend, indemnify, and hold harmless Ozjam, its directors, managers and employees from any loss, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Ozjam Service that infringes or is otherwise in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth above and/or if any Content that you post on the Ozjam Site or through the Ozjam Service causes Ozjam to be liable to another. This indemnity shall be applicable without regard to the negligence of any party including any indemnified person.
    • To the maximum extent permitted by law we exclude all implied representations and warranties which, but for the Ozjam Terms,might apply in relation to your use of Ozjam.
    • To the extent that our liability cannot be excluded by law our maximum liability to you for any cause whatsoever and regardless of the form of action will be limited to the amount paid by you (if any) for any chargeable service on Ozjam.
  • General Provisions
    • This Agreement and its Terms, accepted by your use of the Service, and further affirmed upon registering for the Service, contains the entire Agreement between you and Ozjam Australia regarding your use of the Ozjam Service including the Privacy Policy.
    • No partnership, joint venture, employment, or agency relationship exists between you and us as a result of the Ozjam Agreement or your use of Ozjam.
    • In the event of any conflict between the Privacy Policy and this Agreement, this Agreement shall control. Unless otherwise explicitly stated, this Agreement will survive termination of your membership to, or use of the Service and remain in effect.
    • This Agreement operates to the fullest extent permissible by law. If any provision of the Ozjam Terms is held to be invalid the remainder of the Ozjam Terms shall continue in full force and effect.
    • The failure of Ozjam to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
    • The section titles in this Agreement are for convenience only and have no legal or contractual effect
